Terms of Service

These Terms of Service govern access to and use of the GoBalik platform and Services.
By creating an account or using the Services, users agree to these Terms.
1. Eligibility
Users must have legal capacity to enter binding agreements under applicable laws.
2. Nature of Services
GoBalik provides software tools and infrastructure for loyalty programs, digital stamp systems, QR loyalty systems, NFC interactions, customer retention systems, and merchant analytics.
3. Clickwrap Acceptance
By registering an account or using the Services, users acknowledge and agree that acceptance through electronic acknowledgment or checkbox confirmation constitutes legally binding acceptance of these agreements.
4. Merchant Responsibility
Merchants are solely responsible for rewards issued, loyalty program mechanics, customer interactions, promotional claims, compliance with laws, customer disputes, and industry-specific compliance obligations.
5. Loyalty Point Rules
Unless otherwise specified by the Merchant:
- loyalty points have no cash value
- loyalty points are non-transferable
- points may be revoked for fraud or abuse
- rewards may be modified or removed
- accounts may be suspended for abuse
6. Fraud and Abuse Enforcement
GoBalik reserves the right to suspend accounts, revoke points, remove fraudulent rewards, reverse loyalty actions, restrict platform access, and investigate suspicious activity.
7. Platform Restrictions
Users may not reverse engineer the platform, clone platform systems, replicate workflows, scrape platform data, benchmark the platform for competitive replication, attempt unauthorized access, exploit vulnerabilities, automate abuse, or create fake loyalty activity.
8. Intellectual Property
All platform systems, workflows, software logic, interfaces, branding, infrastructure, and proprietary functionality belong exclusively to GoBalik.
No ownership rights are transferred to users or Merchants.
9. Merchant Branding Rights
Merchants grant GoBalik permission to use business names, logos, public-facing screenshots, platform previews, and loyalty visuals for marketing, portfolio, promotional, demonstration, and platform showcase purposes.
10. Beta Disclaimer
GoBalik may release beta or experimental features which may be unstable or incomplete.
Such features are provided without guarantees.
11. No Guaranteed Uptime
The Services are provided on an “AS IS” and “AS AVAILABLE” basis.
GoBalik does not guarantee uninterrupted access, uptime guarantees, error-free operation, or continuous availability.
12. Backup Responsibility
Merchants are responsible for maintaining independent records of critical business information including sales records, loyalty data, customer records, and operational reports.
13. Limitation of Liability
To the maximum extent permitted by law, GoBalik shall not be liable for lost profits, business interruption, lost data, corrupted records, loyalty inconsistencies, reward disputes, merchant-customer disputes, QR failures, NFC failures, duplicate rewards, or platform downtime.
Maximum liability shall not exceed the total amount paid by the Merchant to GoBalik during the six (6) months preceding the claim.
14. Suspension and Termination
GoBalik may suspend or terminate accounts for violations of these agreements.
Where reasonably possible, warnings may be issued prior to enforcement actions.
Immediate enforcement may occur in cases involving fraud, abuse, security threats, or illegal activity.
15. Governing Law
These Terms shall be governed by the laws of the Republic of the Philippines.
16. Changes to Terms
GoBalik may modify these Terms at any time.
Continued use of the Services constitutes acceptance of revised Terms.
