Welcome to GoBalik (“GoBalik”, “Company”, “we”, “our”, or “us”).
This Privacy Policy explains how GoBalik collects, uses, stores, processes, protects, and discloses information in connection with the use of the GoBalik platform, including loyalty systems, digital stamp systems, QR-based loyalty interactions, NFC-enabled interactions, merchant analytics systems, websites, dashboards, APIs, and related services (collectively, the “Services”).
By accessing or using the Services, users acknowledge and agree to this Privacy Policy.
1. Scope
This Privacy Policy applies to merchants using GoBalik, merchant staff accounts, end customers interacting with loyalty programs powered by GoBalik, and visitors accessing GoBalik systems or websites.
2. Information We Collect
Merchant Information
We may collect business names, business contact information, merchant account credentials, billing-related information, support communications, uploaded branding materials, and operational data related to loyalty program usage.
Customer Information
Merchants may collect and process customer information through the GoBalik platform including mobile numbers, email addresses, loyalty activity records, digital stamp activity, transaction-associated activity, reward redemption history, and purchase-related history where enabled by the Merchant.
Automatically Collected Information
GoBalik may collect operational and technical information including IP addresses, browser information, device information, authentication logs, access timestamps, platform interaction logs, fraud detection signals, and system diagnostics.
3. How We Use Information
We may use collected information for operating the platform, managing loyalty functionality, maintaining authentication systems, fraud prevention, abuse monitoring, analytics and operational improvements, troubleshooting, legal compliance, enforcement of platform policies, platform security monitoring, and feature development and beta testing.
4. Fraud Monitoring and Security Enforcement
GoBalik reserves the right to monitor activity across the platform for fraud prevention, abuse detection, QR exploitation detection, NFC abuse detection, fake transaction detection, loyalty manipulation detection, account compromise investigations, and platform integrity enforcement.
GoBalik may investigate suspicious activity and take enforcement action where necessary.
5. Merchant-Customer Relationship
The relationship between Merchants and their customers belongs solely to the Merchant.
GoBalik acts as a technology platform provider and does not assume responsibility for merchant-issued rewards, customer disputes, or merchant business practices.
However, GoBalik reserves the right to intervene where necessary for fraud prevention, abuse investigations, legal compliance, platform security, and enforcement of platform policies.
6. Data Retention
GoBalik may retain account and operational data for up to thirty (30) days following account termination or deletion requests for account restoration requests, fraud investigations, dispute resolution, legal compliance, backup integrity, and security investigations.
After the retention period, data may be permanently deleted where operationally feasible.
7. Data Deletion Limitations
Users acknowledge that deletion from active systems may not immediately remove data from backups, logs, disaster recovery systems, and archived infrastructure systems.
8. Data Export Restrictions
Merchants may not have unrestricted rights to export customer data from the platform unless explicitly authorized by GoBalik.
9. Security Measures
GoBalik implements commercially reasonable safeguards including authentication systems, access controls, logging systems, infrastructure protections, and restricted administrative access.
Despite such measures, no system can guarantee absolute security.
10. Beta Platform Disclaimer
Certain features of the Services may be designated as beta, experimental, or early-access features. Such features may contain bugs, interruptions, inaccuracies, incomplete functionality, instability, and unexpected behavior.
GoBalik reserves the right to modify or remove beta features at any time without notice.
11. Downtime and Availability
GoBalik does not guarantee uninterrupted availability of the Services.
Temporary interruptions may occur due to maintenance, infrastructure failures, emergency security actions, third-party failures, software bugs, and force majeure events.
Emergency maintenance may occur without prior notice.
12. Philippine Data Privacy Compliance
GoBalik aims to operate in accordance with the principles of Republic Act No. 10173, also known as the Data Privacy Act of 2012 of the Republic of the Philippines.
13. Minors
Certain Merchant industries may impose age restrictions.
Merchants are responsible for ensuring compliance with age-related laws applicable to their industry.
14. Changes to this Privacy Policy
GoBalik may modify this Privacy Policy at any time.
Continued use of the Services after modifications constitutes acceptance of the revised policy.
